Legal Heir Certificate for Shares
What it is
A legal heir certificate lists the surviving family members of someone who has died. It’s issued by your local revenue office (tehsil) or municipal authority, and it shows who can claim the shares. It isn’t the same as a succession certificate, and one can’t replace the other. Which one the registrar accepts depends on your case, and getting the wrong one can cost months.
When you need it
The shareholder died without a nominee, and the family needs to show who can claim.
The registrar has asked for proof of who the heirs are.
Several family members are entitled and all need to be named.
When you don’t
A nominee was named, which is usually the quicker route.
There’s a will that shows who inherits, which needs different papers.
The registrar has asked for a succession certificate instead, which comes from a court.
