Your question, answered

A family member has died and held shares. What happens now?

We’re sorry for your loss. The shares stay with the family. What comes next depends on the nominee, the will and who can claim.

Hello — I’ll walk you through this. Six short questions.

Which Is Closest to Your Family?

Every one of these can be solved. Only the papers change.

A nominee was named

Usually the quickest route.

There is a will

We check how the will and the share records fit together.

There are several heirs

We help the family agree the plan before the claim starts.

What changes the route.

Was a nominee named for the shares?

If yes

That’s usually the quickest route. The registrar looks for a nominee first, though a few papers are still needed.

If no

Then the family shows their right another way: through a will, or through succession if there’s no will. Both work; they just need different papers.

Is there a will?

If yes

That helps. Whether it needs to be proved in court depends on the case, and it’s worth knowing before you start.

If no

Very common, and not a barrier. Without a will, the heirs claim through succession instead.

Is more than one person entitled to the shares?

If yes

Then the registrar usually needs all of them to claim or sign a release. These cases stall most when one person is hard to reach, not because of anything technical.

If no

That keeps things much simpler.

Do you know which companies the shares were in?

If yes

Then we can go straight to checking what’s held.

If no

That’s a common start too. We regularly trace what someone held, often from very little.

Inherited Shares: Questions Families Ask

Clear answers before you decide anything.

Do shares disappear when a shareholder dies?

No. The holding remains and can pass to the people entitled to it through transmission.

Can a nominee claim the shares?

A registered nomination is an important starting point. The complete route depends on the holding and family facts.

What if there is no will?

A claim can still proceed through the applicable succession route.

What if nobody knows which shares were held?

Tracing can begin from the shareholder’s name, old addresses and any financial references the family finds.

Can several companies be reviewed together?

Yes. We can organise multiple holdings and identify the route that applies to each one.
